# 268 - Supreme Court Gets It Right!

Supreme Court Upholds Law Against Child Porn

WASHINGTON, May 19 /Christian Newswire/ -- "We have long held that obscene speech-sexually explicit material that violates fundamental notions of decency-is not protected by the First Amendment," begins the opinion handed down today by the Supreme Court in US v. Williams, a clear statement of law too often overlooked by our judiciary and law enforcement. In a 7-2 decision, the Court reversed the Eleventh Circuit opinion declaring the 2003 law unconstitutional and restored the much needed protections against the distribution of child pornography.

Concerned Women for America (CWA) applauds the decision by the Supreme Court to uphold a law that will protect families and punish those who traffic in child pornography.

Justice Scalia, who wrote the opinion of the Court, said, "Child pornography harms and debases the most defenseless of our citizens. Both the State and Federal Government have sought to suppress it for many years, only to find it proliferating though the new medium of the Internet."

"The Supreme Court got it exactly right," said Mario Diaz, CWA's Policy Director for Legal Issues. "Child pornography is a growing problem in our society and we must use every weapon at our disposal to fight against it. There is no violation of the First Amendment right to free speech here. After all, the material at issue is illegal child pornography. The mere possession of it is in violation of the law.

"It is clear the federal government has a compelling interest in protecting children, and this statute goes after individuals with a specific intent to pander the material. A law that protects children in such a significant way should not be struck down simply because there might be one person somewhere in Fantasyland that, given the right circumstances, might say it violates their free speech. That is nonsense and I'm glad the Justices saw through their mythical arguments."

# 267 - Toddler Found Okay!!

After the search was called off last night, the people on a ranch behind the area where Isabelle was missing from refused to stop. They continued to search with four-wheelers and flashlights. About 12:30 this morning they found Isabelle in a thick under brush area alive and well. She had wandered off and was lost. She was taken by ambulance to the local hospital for observation and is fine. Prayer does work, God is still on His Throne, and we give Him all the glory for inspiring those people to continue searching and the Holy Spirit for leading them to Isabelle. Thank You Jesus for Your guidance, Your hedge of protection around Isabelle and for giving the angels charge over her to hold her safe until You led those people to her, in Jesus' Name. All praise, honor and glory to our Heavenly Father.

United Methodist General Conference Takes Steps to Affirm Life

Conference delegates voted to:

On last Wednesday, the Dr's felt that my mom was not strong enough to have a pacemaker put in and would be in ICU from 7 to 20 days to become a candidate for the procedure. On last Thursday AM they were greatly surprised at her progress, overnite, and scheduled the procedure for that day! Mom was home in time for lunch on Friday!!! # 263 - Divestment Dies At Conference!

UM Action Celebrates Downfall of Anti-Israel Divestment Proposals

"Anti-Israel Divestment seems to have died within the United Methodist Church. Good Riddance!" - UM Action Executive Director Mark Tooley

FT. WORTH, Texas, April 28 /Christian Newswire/ -- Several sweeping divestment proposals aimed against Israel have been defeated in committee at the General Conference of the United Methodist Church. They now appear to be dead. The proposals, which exclusively faulted Israel for strife in the Middle East, would have moved the church to divest itself of investments in companies that did business with Israel.

In addition to the defeat of the divestment proposals, the United Methodist General Board of Church and Society (GBCS) at first submitted, but then withdrew legislation to divest the United Methodist Church from Caterpillar, Inc. because it sells equipment to Israel. GBCS alleged that Caterpillar bulldozers support Israel's so-called occupation of the Palestinians.

The conference, United Methodism's chief rulemaking body, is a denominational gathering that occurs every four years and brings together delegates from around the world.

I was hurting from rejection, I was in desperation to be loved, I was lonely, out of the rejection I put up walls and had a hostile attitude but not aggressive per se, I had gotten into satanism and evil music which glorified death. Anyway I was suicidal, had a gun, and God said go get a Bible. Now I did not have a Bible, and I had not had one in years. So, I got a Bible, turned my heart to the Lord, burned my satanic books, sold my CDs, went to church, and I sought out God, Who showed me His spirit. It's been several years now.

# 259 - Rob Goes Home....

Rob went home yesterday, all the tests showed it was not his heart, so they gave him a "green slime cocktail" and it took away the burning and pressure ...who knows??? The devil is a liar, and he can't shut our mouths! We will proclaim the good news of Jesus as loud and as long as we can! Amen!!!

# 258 - Baby Callie Goes Home!!

We're home! We're home! We're home! 2 days short of nine months!

It was a crazy day. I woud've been easier to organize the next olympic games at our house that it was to transition back home. We had to have 3 different companies come together at a moments notice. Meds, insurance, equipment, home health care, education, packing, unpacking.... it goes on and on and I can honestly say this was one of the most stressful days of my life, but at the same time one of the most rewarding.

I surprised Noah when he came off the bus at 3pm. He saw me at the end of the street and started screaming and running towards me. I called out "Callie's home, we're home for good!" and he voice started cracking and he squeeled "Really?!!" and dove into my arms in front of the driveway.

Callie took no time making herself at home. As you can imagine, most of the Wal-Mart toy deptartment inventory is sitting in our living room, and to Cal, long abandoned toys are as good as new ones. She was tearing through everything, didn't skip a beat. The problem we had was keeping her close enough to the feeding pump. The tube to her stomach works as a leash. We are beginning to realize how much of a problem this will be.

Cozy has taken to making Callie her personal doll, we found her dressed in a tiara, necklaces, and a hat when we turned around after putting up the meds in the other room.

Nurse Kathy and Callie were reunited. Nurse Kathy came bounding in with a big mylar balloon with her which Callie is sleeping with right now.

I've accepted I probably won't be having a normal living room for a while. But it's a happy living room. the couch and table are against the wall. A crib mattress and pillows lay on the floor with all Callie's equipment, all Callie's toys, and most importantly, Callie. Most of our time, the five of us, is spent on the living room floor. Callie was the happiest I've seen her. No confines, no bars, no wires.

She's taken to her Daddy quite a bit. Every time she couldn't see him she'd sing "Daddy, where are you?" or "Where Daddy go?". I am happy to see how quickly she's forged a bond with him after being apart for so long. Callie was showing Nurse Kathy all her new tricks, her very expanded lexicon, and how she can crawl. She is everyone's miracle.

As for me, I'm tired, very tired but too wired and anxious to sleep it'll take a while to wind down from the past 48 hours. Cal eventually sacked out about a half hour ago. As crazy as it was, we are fairly well organized and Callie transitioned beautifully.

You guys have been wonderful to leave as many messages as you did for Ashton Evans. His Dad left an update in the form of a post on the message board. From what I gathered, the doctors are perplexed as he should b e getting better and he's not. Please continue to pray.

# 257 - Eyes Are Healed!

Just a note updating on recent cataract surgery and my friend's, Maryann, knee surgery.

I CAN SEE without glasses ...I'm just in awe everyday!!! The Lord surely came through when he promised me my eyes shall be healed in Matt 9:29 ...have worn glasses for 40 years and don't miss them one bit; although, I'm still using reading glasses (drug store ones) until final prescription is made up in 4-6 weeks. It all just still amazes me....

As for Maryann, she's still hobbling around the house but, doing quite well ...she's a real trooper and prayer warrior too! She thanks you, as I do, for your prayers ...all to His glory! Amen? Amen.

Today morning at 11 am we had a cottage meeting at non-Christian house, and my family and some of the believers went and delivered the Word of God and prayed for the sick and for the blessings. Many were believed and exprressed to come to the service from next sunday on wards.

Lastly this family were offered some Rice and Banana as a love offering. In this way we are serving the lord and with hunger and thirst, but God is great, surely He will make a way for us. Please do uphold us in your prayers. Hope to hear from you.

Yesterday we went see doctor. At that time we got blood result. I praise God. I thank my Saviour Jesus Christ. My husband, Pastor Paul Ciniraj has been healed. He is not a blood cancer patient. Our Lord healed him. His leukemia disappeared. Doctor said it a miracle. Because your prayers. God heard many children's prayers. Sometime my husband's face see black colour. Also his backside of hands below nails. He not black colour man. Doctor said it medicine's reaction. After stop medicine colour come normal. But praise God. We see when he pray his face shines. Bright face we see. At that time his lips shiver. If we touch we get shock (like electricity) from his body. I believe it Holy Spirit's work. Praise God. What God want we ready follow. My husband again start Gospel preaching. He again start Lord's ministry. We now go back. I confess my unbelief. God forgive my unbelief. God forgive my questioning. God purify with your blood. God fill with Holy Spirit. You my Lord, my God. Use me and my family for you.

Day before yesterday my younger son Lesly (13 year old) fall from bicycle. His left hand fracture. Put plaster in hand from hospital. Now he rest in home. We understood it Satan's another temptation. Please pray for Lesly. Plaster remove after 45 days. "

# 252 - Another Answered Prayer!

Earlier in the week I sent in an urgent prayer request. It was for my son that I have prayed many years for him to be saved. He needed divine intervention in a situation. PRAISE GOD !!!!!!!!! God worked everything out.

I am still praying for my son to be saved and for him to realize that it is the Mighty Hand of God he sees working. I pray he will see that God is working on his behalf and that he will be saved. I pray he will see how much God loves him and how much I care about him as his mother.

# 251 - If I Die, I Die!!

I'm rejoicing in my heart!!! I praise God b/c I believe He brought me to a place of rest today. Even though I absolutely reject and rebuke any disease from the enemies hand, I just came to the place of surrendering my life into God's hands. God loves me and He will not allow anything into my life that will not give Him glory and be for my good.

I thank Him for this place of rest today. I don't know what tomorrow will bring but I'm rejoicing today in my father who loves me.

Thank you so much for all your prayer support. God is moving in my New York City (that's where I live), and by His grace I want to be a part of it.

Through this season of fear I've coined the phrase "Find God or die trying!!" By this I mean to seek the Lord with all that is within me. I already know Him as savior and Lord but now I seek to know Him as deliverer and conqueror or die trying. I believe that this is the same spirit which motivated Esther when she went into see Ahaseurus, if I perish I perish but I've got to see him. So in my case if I perish I perish but I'm going after Him.

Late-Abortions Plummet Nearly 30% in Abortion Capital

Total number of abortions also declines

TOPEKA, Kansas, March 31 /Christian Newswire/ -- The Kansas Department of Health and Environment is reporting that the total number of abortions done in Kansas dipped in 2007, with the most remarkable decrease in late-term abortions. Those generally decreased by 23 percent while late abortions done after viability dropped 28 percent.

"We fully expected to see a dramatic drop in late-term abortions in Kansas due to the fact that late-term abortionist George Tiller closed his abortion mill to patients for a record 38 days last summer," said Operation Rescue President Troy Newman. "We believe that closure was a result of a number of factors, including pressure from pro-life groups and criminal charges that were unexpectedly filed against him by the attorney general's office."

"We strongly believe in the power of prayer, and last year Operation Rescue hosted three major prayer events outside Tiller's abortion mill prior to the closure," said Newman. "We also aggressively brought pressure on Tiller's abortion business through our tireless investigations, which have exposed what we believe is criminal activity committed by his abortion staff. We publicly released our information and reported it to law enforcement, the legislature, and other disciplinary groups."

However, the statistics also show an unfortunate increase in the number of abortions done on women who reside in other states. Operation Rescue attributes this increase to the recent closure of several abortion clinics in nearby states.

# 249 - There Was No Tumor!

I asked for prayer for my wife Nadine a couple of months ago, and I want to thank God for His Faithfulness. I want to thank everyone who prayed for Nadine. She was having terrible headaches. She had a Cat Scan done in March, and the results were onderful. There was no tumor. Praise Jesus! The doctor told her she may have had a mini-stroke but wasn't sure when it happened since she had no previous scan. The headaches are almost gone, and she is feeling much bettter.

My brother Bobby is home from the hospital 3 days earlier than doctors told him he could go home. Doc was giving him blood thinner shots and told him his blood wouldn't be thinned enough to go on the blood thinner pill till Monday, so he'd have to stay in the hospital till then. BUT God!!! Pacific Justice Institute has just received word that the court ruling which declared most forms of homeschooling unlawful in California has been vacated. This means the Rachel L. decision, which has sparked a nationwide uproar, will not go into effect as it is currently written. The Second District Court of Appeal has instead decided to re-hear the case, with a new round of briefings due in late April. It would likely take the court several additional months to schedule oral argument and issue another decision.

Today’s announcement by the court that it will re-hear the case reinforces PJI’s position that homeschooling families should continue their current programs without fear of governmental interference. PJI will be actively involved in the upcoming briefs and will continue to post updates and special bulletins on this vital issue.

# 246 - Abortion Mills Losing Ground

Planned Parenthood Woes Continue as National Office Closes South Florida Mills

Operation Rescue Calls for Full Investigation, Defunding of Nation's Largest Abortion Organization

BOCA RATON, Fla., March 24 /Christian Newswire/ -- Planned Parenthood's woes continued as it was revealed last week that a financial scandal and "deficiencies" prompted the Planned Parenthood of South Palm Beach and Broward Counties affiliate to suspend services and correct problems at the demand of the national parent organization. The clinics remain closed to new patients.

Problems with the South Florida affiliate came to light after four board members resigned in protest of improper accounting of funds. The abortion clinic claimed to be financially strapped yet reported an annual budget is $3.9 million, with $441,000 of that coming from state tax dollars. Amid the scandal, the Chief Executive Officer Mary Capobianco tendered her resignation. Several employees have been laid off.

"It has to be pretty bad when the national organization demands that an affiliate suspend operations," said Operation rescue President Troy Newman. "With that kind of budget, there is no reason for dangerous conditions to exist - unless of course, someone is absconding with the money."

"Given the track record of the abortion cartel, it was likely the misuse of money that brought the national organization down on the Florida group, rather than the shoddy clinic conditions," said Newman. "They have repeatedly demonstrated that they care more about money than they do about women."

Other Planned Parenthood affiliates have recently been accused of additional improprieties.

The San Diego and Riverside Counties and the Los Angeles Planned Parenthood organizations have been accused in a civil case of bilking taxpayers out of over $180 million in a financial fraud scandal.

Planned Parenthood of Idaho was forced to apologize after it offered to accept a racially motivated donation that the donor wanted earmarked for abortions on black women.

Planned Parenthood of Kansas and Mid-Missouri faces 107 criminal charges, including 23 felonies, related to unlawful late-term abortions.

An affiliate in Aurora, Illinois, lied on city permit documents in order to build a mega- abortion center in that town.

"Planned Parenthood has been revealed to be a money grubbing group that has little consideration for the law that must be fully investigated," said Newman. "It is unconscionable that our tax dollars continue to prop them up. We applaud recent efforts by Congressman Mike Pence and others to halt Federal funding of Planned Parenthood. # 245 - God Fills A Gas Tank!

I have a testimony to share on God's provision. I went to the gas station this morning and had only $12.00 to put a little under 4 gallons into a big van. I was ministering to the owner of the gas station for about an hour. It was cool. Well I had forgotten I had my van still in the gas pump bays. When I got in my van and started it up, I looked at my fuel gauge to see how much 4 gallons got me. I was on fumes when I came in. To my amazement the needle read past the full mark. I thought at first that maybe my gauge was broke, and when I shut the van off the gauge went back down. When I turned the van on again, it read past full. Praise the Lord! God had somebody plant a seed in my gas tank. I'm praying they get a hundred fold return. What a miracle.

I'm thankful to say ...An agreement to sell the plant where my husband, Michael works at ...has been finalized!! After a long haul since Jan 15 when the company filed for bankruptcy protection and the workers were placed on notice that they would be losing their jobs - A buyer for sure has been found!! Thank you JESUS!!

The sale will of course have to go through a bankruptcy auction on March 27 but, the sale is expected to conclude before April 21. It is possible for a third company to come in and outbid yet but, the interim CEO says that is not likely. So all looks good!! :-)

2.) I feel good today. I'm not as anxious as yesterday. I went to the periodontist, and he said my gums weren't as bad as the other dentist said they were. But it's gonna cost to get them treated. There was one tooth that the other dentist said was very bad and would have to come out. This periodontist said the x-rays the other dentist took looked worse then the one he took today. I've been praying and other people have too, and I believe God is healing my teeth. The other dentist said it would definitely have to come out, but this dentist today said his x-ray showed I may only need a root canal.

Our heavenly Father is so merciful in giving us miracles. There is so much to share and I want adequately articulate what has happened to Ami so you know what God is doing in all of this.

First, Ami is stable. For Ami to be alive is a great miracle. Just a while ago I talked to Yoav, who is at the Ortiz apartment. He told me it is impossible to look at this apartment and belive someone could be alive. The top and bottom floor windows are broken out. There is shrapnel all over the walls. He just pulled a two inch by one inch piece of metal out of the refrigerator. Every piece of furniture destroyed. Like our apartment, their apartment is on the 3rd floor. The windows on a car parked below were blown out from the blast. I tell you all of this to tell you that Ami was holding the bomb when it exploded. He is alive!

I also just got off the phone with David, Ami's father, and it is amazing what God is doing. David could barely talk without crying just sharing with me what has happened so far. The doctor, a specialist in this kind of trauma who has seen several terrorist bombing victims, told David that a miracle has happened. He never seen this kind of recovery!

As I share what he said please make note of the continuing prayer points.

Starting at the head: He left eye is okay. They pulled a large piece of metal out of his right eye and there is still a lot of pressure on that eye. We need a miracle for his right eye. The doctor believes there is a chance now to save it. There is no brain damage! Remember he was holding the bomb! Hallelujah! David said the swelling in his face has also gone down considerably.

Neck: There are large and deep cuts to the neck, but no damage to the main arteries - a miracle.

Chest: One lung was severely damaged and they are in the process of trying to save it. We need another miracle here. The doctor believes there is a chance. No damage to the heart or vessels. Praise God!

Stomach; Most of his internal organs were severely injured from the blast. Reconstruction of the intestines and kidneys was done last night. Today he is able to urinate - a miracle sign that his organs are beginning to work again. He also has 2nd and 3rd degree burns over most of the front of his body.

Legs: The muscle in one of his thighs is completely exposed and terribly lacerated. The doctor believes there is a chance it could be saved. Some news reports are saying that they have amputated the leg, but that has not happened. We are believing for a miracle here to save his leg. He has lost some of his toes. I don't know how many.

I was able to pray with David. It was such a blessing to see his faith. He and Leah have been at the hospital now without sleep going into the second day. Pray for them.

Israel has faced it's share of terrorism in the Jewish community, but never has it faced anything like this .......something solely directed at Messianic Jewish believers. How will God use this? How will He use us and not just our family, but you as well? We must stand with the Body when it suffers. Look at your newspaper and national news .......the world and Israel is watching.

The appellate attorney, Merritt, that you prayed for, has a praise report for you. You prayed for her throat, and it is totally healed now. Her ears were closing, but now they are opening up. Thank you so much for all your prayers on my behalf and for my family.

Judah being back is a huge victory.
On the other hand it does add additional responsibility to me. Right now, I am pretty weary of the battle.Please pray that I would be strengthened.

Also, right now, by God’s grace we are current on all our bills. However, we need a miracle for that to continue. There are some bills on the horizon that in the natural I don’t see how they are going to be paid.

I plan to listen tonight and take communion with you guys.

Well, first I want to thank you for your prayers for the event I mentioned a couple of weeks ago. We had it at our church this past night. Thats why I am still awake right now. It ended up being a conglomeration of stuff God was doing. Praise the Lord that we saw many people come to this event who were unsaved and God is opening doors for many seeds to be sown. I believe this event was just a first of many to come. I was a prayer warrior mainly, but I had the opportunity to hear from others what they heard from the Lord and more. This was an awesome time and a definite learning experience for all who were in a place of leadership.

I guess you can pray for what God is doing in this because it is growing and it's so much bigger than us.

God is attracting other local churches to be a part and more.

I am continuing to ask the Lord for more wisdom on what He wants to do in all this.

We want to see revival come. I am eager to see what happens Sunday morning, because of what happened today.

Testimony # 235

I have to share a PRAISE REPORT with you. Yesterday I had communion with you and prayed with you, and you prayed for my daughter and the children. Today both my daughter and I prayed with you.

My praise report is this. The devil tried to disrupt our home last night, and I told my daughter that something big was about to happen because of this hate attack that came on our home. Today the Holy Spirit woke my daughter up early this morning and put in her mind to contact an attorney to help with an appeal on our case. She began searching out of the yellow pages. Now I must remind you that we have heard that to do an appeal it is about $150,000. We do not have any money. We are living by faith and are behind right now in rent and bills. The third call that Christa made was to a devout Christian appellate attorney named Merritt. She said last night she was crying and asking the Lord to send her a paralegal because she has so much business she needs help. She is taking our case and can't believer how strong our case sounds from what Christa told her. Christa is a paralegal, and so they are going to work together on her other cases as well. She said in the past two weeks three others have come to her with complaints on our Judge Silbar. Thank you, Jesus. Our case can be used to break open the corrupt and demonic Family Court System!!

Please pray for wisdom and supernatural guidance with the development of this case. Please pray for attorney Merritt's health. She is asking prayer for a cough that doesn't want to stop. Father, we ask for a Hedge of Protection, which is Yourself, around Merritt. Spirit of healing, create in her body new tissue where necessary, and we take authority over this woman of God and command the spirit of infirmity to leave Merrit, and we seal the door with the blood of Jesus. We praise and thank Jesus for his sacrifice of healing!

Thank you for your prayers. We are in a special time in time history. Prayer and love is the most critical weapons we have. In God's sovereign plan we are here to bring the Light of Jesus to this broken world. I pray for your ministry of prayer and worship. Father, I hold Jeff and this Night Watch Ministry. With praise to God and gratitude in our our hearts, we are pleased to let you know that Marie-Toni Tinshu was born on March 3, 2008 at 7:38pm South Africa Time (6:38pm Cameroon time):

Despite the limited access we hav to internet and the nature of our studies, we are still determined to keep you informed.

Marie-Toni is a miracle baby because she was coming to the outside world without labour pains, and so the doctors had to do a C-Section on Marceline for her to be out!! They were discharged from the Pretoria Academic (University) Hospital on March 5 and they are home enjoying the Lord and doing very well. Marceline is recovering very fast from the surgery.

Marie Catto is the wife of Dr. Graham, and she has been so gracious to us since we arrived here. When Marceline felt uneasy and I called Paul, he came with his wife Toni (nurse) who was so help and knew exactly what to do with the prolapsing cord that saved the baby's life. That is why the baby's first name is Marie-Toni, just in case you were wondering why that name.

Her middle name will be Wonderwerk meaning Miracle in Afrikaans. While I was at home wondering what her middle name should be, I felt God say Miracle. The following day when I went to the hospital, Marceline said, why can't the child's name be Miracle in Afrikaans. That was a perfect confirmation. So, the full name will be Marie-Toni Wonderwerk Tinshu. Isn't that lovely!!

40 Days for Life Effort Wraps Up Sunday; Lives Saved, Awareness Raised

WASHINGTON, March 14 /Christian Newswire/ -- "We are seeing a tremendous change taking place across the nation as our second simultaneous coast-to-coast 40 Days for Life campaign draws to a close," said David Bereit, national campaign director of 40 Days for Life.

In this campaign, which began February 6 and ends March 16, people in 59 cities in 31 states joined together for 40 days of prayer and fasting for an end to abortion, 40 days of constant, peaceful vigil outside abortion facilities and Planned Parenthood offices and 40 days of pro-life community outreach.

I have had some great meetings in MN and PA this past week. Thank you, for standing with us in prayer during this intense season of our lives. Yes, we continue to declare that we are on the verge of a miracle! Michal Ann has taken a great turn for the good. She completed her third round of chemotherapy this week and her cancer markers keep going down!

Michal Ann is getting stronger and is cutting back on the amount of oxygen she has been on. We must see all the cancer eradicated and my wife fully restored to complete health. Keep praying with us!

Judge Rules that God is Still Welcome in Millersville, Tennessee

Court Holds City Cannot Deny Ministry's Rights through Legal Maneuverings

WASHINGTON, March 10 /Christian Newswire/ -- Score one for the little guy. And the Big Guy.

The United States District Court for Middle Tennessee ruled that the city of Millersville, Tenn. violated the constitutional rights of Layman Lessons when it threatened application of a "pending zoning ordinance" as a means of blocking the ministry's use of a commercially zoned property.

"The Court rejected the city's contention that, as long as it had a pending ordinance that addressed Layman Lessons' intended use of this property, it could indefinitely delay acting on the ministry's application," said Larry Crain, a senior attorney with the American Center for Law and Justice (ACLJ) and lead attorney for the plaintiff. "In essence, the court ruled that 'justice delayed is justice denied.'"

Problems arose for Layman Lessons, a Christian ministry formed to aid the homeless and destitute, when it first applied for a use permit for a commercially zoned property in Millersville, a town 17 miles north of Nashville. Shortly after the ministry applied for a permit the city planner, James Lech, issued a letter rejecting the application due to a then- pending ordinance that, if passed, would have limited all religious and non-profit uses on any commercial lot in the city. City Manager Robert Mobley supported Mr. Lech's recommendation. The effect of these actions was to place Layman Lessons' application on indefinite hold.

Judge Thomas A. Wiseman, Jr. concluded that through these maneuverings the city denied Layman Lessons its constitutional rights in violation of the Religious Land Use and Institutionalized Persons Act (RLUIPA).

As a further hurdle to the ministry's use of the land, the city imposed a so-called "buffer strip" requirement on the property. Such strips, which require an expensive privacy fence to be constructed around the property, had heretofore only been required when a commercial property abutted a residential property. The Layman Lessons' property was surrounded on all sides by commercially zoned properties.

The city of Millersville had argued that it could not be held liable under RLUIPA for the actions of employees who were not part of the top echelon of policymakers. Judge Thomas A. Wiseman, Jr. rejected this argument ruling that the actions of the city planner and city manager constituted a violation of RLUIPA. The city will be responsible for a portion of Plaintiff's legal fees.

"Judge Wiseman's ruling confirms that Tennessee is still a place where the rights of the "Davids" cannot be casually usurped by the "Goliaths" of this world," concluded Attorney Crain.

I just wanted to tell you that Ed has not taken any pain pills for the last couple of weeks. He hasn't even taken ibuprofen either.... how cool is that! He was looking for something at our old pharmacy, and he came across a back brace that happened to be just his size, thank you God. He has been wearing that, and he has been doing his physical therapy exercises everyday. So, I just wanted you to know that God has really answered prayers, and really touched our lives in a fresh way. That has been the best thing in all of this, God has let us become aware of how close He is.... He is so faithful, and so Good!!!

The doctor that Brittney works for looked at the x-rays, and he says that he thinks it's the density of her breast because he can see it from the front view but not from the side view. GREAT ...they did Vicky's surgery vaginally and found some cells on her bladder which they removed. The doctors are very hopeful that they got all the cancer. More tests later but for now, no chemo. Praise God. I'm believing we got a miracle.

Called Danny last night, and he said that the preacher that came and saw him, came again and brought 7 men from the Teen Challenge program with him.

A couple of the guys gave their testimonys. Danny said that the preacher and one of the guys were crying.

They told him they were getting funds together to pay the $1,000.00 for Danny to go there, that when he gets out of the Hospital to give them a call, and they would come from San Antonio and pick him up.
